1. Terms and definitions used in the Agreement
In the Agreement, if the text of the Agreement does not directly imply otherwise, the following words and expressions will have the following meanings:
1.1. The Website is a set of software and hardware for computers providing the publication for general review of information and data united by a common purpose, through technical means used for communication between computers on the Internet. The Website is on the Internet at: tvbrics.com.
1.2. The Administrator / the Owner of the Website is the joint-stock company "TV BRICS" (PSRN 1177746976142, ITN 7727329908), located at: Russian Federation, 127287, Moscow, Inner territorial city Municipal district Savelovsky, Khutorskaya st. 2/29, p. 4.
1.3. The content of the Website is recognized by all objects posted on the Website, including design elements, text, graphics, illustrations, videos, scripts, programs, music, sounds and other objects and their collections. The Owner of the Website has the exclusive rights to use the Website, including all the content of the Website.
1.4. The User is the user of the Internet, and the Website in particular.
2. General provisions
The given Agreement states the terms for the User to use the website tvbrics.com (hereinafter referred to as the "Website"), which is an information resource provided by JSC BRICS TV.
The given Agreement is concluded between the Owner of the Website and any person becoming the User of the Website after accepting all the terms of this Agreement.
In accordance with Article 435 of the Civil Code of the Russian Federation, these Terms of service recognized as an offer.
In accordance with Article 438 of the Civil Code of the Russian Federation, an unconditional adoption (acceptance) of the terms of this Agreement is the fact that the User began to employ the Website services provided by the Website Administrator.
The Agreement, concluded by the acceptance of this offer, does not require bilateral signing and is in force in electronic form.
By accessing the Website, the User accepts the terms of this Agreement in full.
The Owner of the Website reserves the right to change the terms of the Agreement and all its integral parts without consent of the User with notification of the latter by posting on the Website a new version of the Agreement or any integral part thereof that has been changed. Taking into account that the newsletter can be recognized as spam by the Parties, the User undertakes to get acquainted with the contents of the Agreement posted on the Website at least once a month in order to know its changes. The new version of the Agreement and/or any integral part thereof shall come into force from the moment of publication on the Website, unless another term for the entry into force of the changes is determined by the Owner of the Website upon their publication.
The current version of the Agreement and all annexes to it are always on the Website in public access at www.tvbrics.com/en/terms.
JSC TV BRICS has the right at any time to terminate or change the procedure for providing (on a permanent or temporary basis) services to the User or all users exclusively at their discretion and without sending prior notice. The User has the right to stop using the Services at any time without notifying JSC TV BRICS.
3. The Website terms of use
The User is personally responsible for any information that is posted on the Website, informs other Users, as well as for any interactions with other Users.
The Website contains materials protected by copyright, including, but not limited to, trademarks, texts, photographs, video materials, graphics, music and sound works.
Moreover, all content of the Website is protected by copyright as a work created by collective creative work in accordance with the legislation of the Russian Federation on copyright and related rights. JSC TV BRICS owns the copyright as the selection, arrangement, systematization and transformation of the data contained on the Website, and the actual data itself, except for cases specifically established by this Agreement or separately noted in the content of the materials published on the Website. The User has no right to modify, publish, transfer to third parties, participate in the sale or assignment, create derivative works or otherwise use, in whole or in part, the content of the Website. The information indicated on this Website is presented as public information (unless otherwise specified in the materials) and can be freely distributed, or copied for non-commercial use only for information, scientific, educational or cultural purposes. The use of any material posted on this Website, quoting in the media is possible only with reference to the source indicating the Internet page from where these materials were taken.
Unless otherwise provided for by the law on copyright and related rights, it is not allowed to copy, distribute, transfer to third parties, publish or otherwise use the Website materials for commercial purposes without obtaining the written permission of JSC TV BRICS or other lawful copyright holder.
The User undertakes not to download, post or otherwise use on the Website any materials that are subject to copyrights or other rights of a third party (including the right to privacy or the right to image of a citizen), without the consent or permission of the copyright holder, or other legally justified right to upload, post and make available to the public the relevant material. The user is solely responsible for any damage arising from copyright infringement or other rights to protected materials, as well as for any damage arising from the loading of such materials on the Website. When downloading any materials to the sections of the Website for general use, the User thereby automatically provides JSC TV BRICS or confirms that the owner of such materials has provided JSC TV BRICS with a free, permanent, irrevocable, non-exclusive right to using, editing, publishing, translating and disseminating such materials (in part or in full) in all countries of the world and/or including such material in other works in any form through the use of any media or technology now known or that may be invented in the future, the entire maximum possible under the law validity of the copyright with respect to such materials. The user also authorizes the access, viewing, storage or reproduction of such materials to other Users for personal use.
The Owner of the Website has the right:
- To dispose statistical information related to the operation of the Website, as well as information of Users to provide targeted display of advertising information to different audiences of the Website Users.
- To direct the User information about the Website development and its services; send messages for the purpose of informing about activation codes, conducting surveys on the quality of the Website work, providing and requesting other information, as well as advertising their own activities and services.
4. Exemption clauses
The User hereby assumes all risk of using the Website. Neither JSC TV BRICS, nor its employees, agents, suppliers or content producers, licensors, guarantee the absence of errors or the continuous operation of the Website. In doing so, the above-mentioned persons do not give any guarantees regarding the possible results of using the Website or with respect to the accuracy, reliability or content of any information, service, product and Services sold through the Website.
The Website services are provided on an "as it is" basis, without providing any warranties, direct or implied, including the warranty of merchantability for any particular purpose. It does not exclude guarantees that follow from the law or cannot be excluded, restricted or amended by virtue of the legislation applicable to this Agreement.
Under no circumstances shall JSC TV BRICS and persons engaged in the creation, production or distribution of products of the Website or the software of the Website be liable for any damages, including without limitation direct and indirect damages or losses caused by the consequences of using the Website, as well as losses from the payment of fines arising in connection with the use or inability to use the Website. The User hereby acknowledges that the provisions of this section apply to all content on the Website.
The User agrees:
- To compliance with the terms of the given Agreement.
- Do not transfer information about other Users received through the Website to third parties.
- Do not post personal data of other persons on the Website, or use personal data of other Users in any way that does not comply with the requirements of the Russian legislation, for unlawful or illegal purposes, for profit and any other purposes that do not correspond to the purposes of creating the Website.
- Do not use the software and perform any actions aimed at disrupting the normal operation of the Website and its services; Do not use automated scripts (programs) to collect information on the Website and (or) interact with the Website and its services without the special permission from the Owner of the Website.
5. Privacy and protection of personal data
Within the framework of the Agreement, the personal data of the User means:
- personal data that the User provides about himself while registering (creating an account) or while using the Website, or other data provided by the User at his discretion;
- data that is automatically transmitted during use by means of the software installed on the User's device, including the IP address, information from cookie, information about the User's browser (or other program that accesses the Website), access time , the address of the requested page;
JSC TV BRICS has the right to request the User personal data through the Website, and the User has the right to provide such data.
Voluntary registration of the User on the Website for the purpose of participating in the projects of JSC TV BRICS and gaining access to the services of the Website means full consent in accordance with Article 9 of the Federal Law as of July 27, 2006 No. 152-FZ "On Personal Data" for automated, also without using means of automation, processing and use of their personal data provided by JSC TV BRICS, as well as guarantees the reliability of the data provided. Processing and storage of the User's personal data is carried out in accordance with the current legislation of the Russian Federation.
JSC TV BRICS collects and stores only those personal data that are necessary for the provision of services and can be used for the following purposes:
- identification of the User on the Website and provision of personalized services of the Website;
- communication with the User, including sending notifications, requests and information concerning the use of information products, information materials and/or data of the Website;
- rendering services, as well as processing requests and applications from the User;
- targeting promotional materials;
- carrying out statistical and other researches;
- general information on surfing on the Website for content optimization.
With the User personal data, the Owner of the Website can take the following actions: collection, recording, retrieval, systematization, accumulation, storage, use, transmission (distribution, provision, access). Personal data can be used in a mixed way, using the information and telecommunications Internet network and cross-border transmission.
JSC TV BRICS preserves the confidentiality of the User's personal data, except for cases of voluntary provision of data about himself to the public for unrestricted access to certain services, including third-party services (for example, Facebook, Twitter, VK etc.) The user agrees that a certain part of his personal data becomes publicly available.
The User is aware that in case of authorization on the Website through social network accounts, the rules and conditions of the relevant social networks, including processing and use of personal data and ensuring their confidentiality, apply to it.
JSC TV BRICS has the right to transfer the User's personal data to third parties in the following cases:
- The User gave his consent to such action;
- transfer is necessary in the framework of the User's employment of a certain service or for rendering services to the User;
- in order to comply with the requirements of legislation or court decisions, to protect the rights and legitimate interests of JSC TV BRICS, to protect the personal safety of the Users of the Website.
The User can change the personal data provided by him at any time, as well as delete it within the specified account.
JSC TV BRICS takes necessary organizational and technical measures to protect the User's personal data from unauthorized access, destruction, modification, blocking, copying, and distribution.
The terms of Section 4 apply only to tvbrics.com. JSC TV BRICS does not control and is not responsible for the sites of third parties to which the User can click on the links available on the Website. The User must independently familiarize himself with the terms of protection of personal data on such websites.
6. Consent to the terms of the Agreement
The given Agreement shall enter into force upon entry on the Website. If you do not fully accept the terms of the Agreement, please leave the Website immediately.
